Consumer Virtue - Terms of Service
General
You are urged to read these terms and conditions carefuly and to communicate any questions that may arise regarding your benefits package to our benefits pack advisors. The benefits package is only available to residents of the UK, Channel Islands & Isle Of Man, aged 18 or over .
Definitions:
“Benefits” means the discounts and/or other benefits relating to certain services offered by the Suppliers and to which you are entitled as a Package holder and as described in the Benefits Pack. “Benefit Terms” means the terms and conditions governing the use of the Benefits or redemption of a Voucher and which are listed on the Vouchers, in the Benefits Pack or on the Website. “Member” or “you” means the person whose name appears on the Order Acknowledgement.
“Benefits Pack” means the pack sent to you containing the Vouchers and information on the Benefits, the Suppliers and the Vouchers. “We”, “us” or “our” means Consumervirtue.com, at the following Address: 2 Cavaye House Cavaye Place London SW10 9PT.
“Freetime Savings Club” or “Freetime Savings” means the club we have partnered with to provide its benefits to you, known as Freetime Savings Club.
“Start Date” means the date on which your package was sent and which appears on the Order Acknowledgement. “Order Acknowledgement” means the form sent to you with the Benefits Pack, which acknowledges your eligibility to use our Benefits Pack (as applicable) and which contains details of your Benefits Pack and other information relating to your order. The exact name by which this form is described may vary.
“Refund” means the refund we will give you on your Benefits Pack Fee if you return your Benefits Pack within the timescale set out in paragraph 4 below, on the Order Acknowledgement sent to you by us with the Benefits Pack.
“Supplier” means any supplier of the Benefits as listed in the Benefits Pack or on the Website. “Voucher” means any voucher contained in your Benefits Pack that may be redeemed for a Benefit. “Website” means www.consumervirtue.com or such other replacement site(s) as we may set up from time to time.
Benefits Pack. You are entitled to the Benefits, as explained in the Benefits Pack and which will be subject to the applicable Benefit Terms.
Benefits Pack term. Starts on the Start Date and shall continue for a period of twelve months thereafter. For the avoidance of doubt, therefore, you should be aware that your Benefits Pack.
Cancellation of Benefits Pack (30-day money back guarantee)
You may cancel your Benefits Pack purchase at any time during the 30-day money back guarantee period, we will issue a full refund to your billing source. You may cancel your Benefits Pack within this timescale by telephoning our benefits Pack advisors on the telephone number set out in your Benefits Pack. Within 21 days of notifying our Benefits Pack advisers of your wish to cancel your purchase, you should return the Benefits Pack (together with details of your name and address) to us at the address we will provide you with when calling. We recommend that you obtain a stamped receipt from the Post Office or other proof of posting. In the event that you have failed to return the Benefits Pack to us within the 21 day period stated above, we reserve the right either to charge you or to deduct from the Refund a sum equivalent to the direct cost to us of recovering the Benefits Pack and such sum shall not exceed £10.00.
Use of your Benefits Pack
You will promptly notify us if you become aware of any unauthorised use of your Benefits, or if your Benefits Pack or any of the Vouchers are lost or stolen.
Responsibility
In the event of any breach of contract on our part, we shall not be liable for any loss, damage, cost, or expense arising out of the breach which was not reasonably foreseeable by us at the date on which you purchased the benefits package. You should also note that we do not provide any of the Benefits ourselves; these are solely provided by participating Suppliers. If you have any queries, complaints or claims relating to any of these Benefits, you should deal directly with the Supplier providing the Benefit. In the absence of any negligence or breach of duty on our part, we cannot and do not accept any responsibility for the services provided by any of the Suppliers or any breach of contract or negligence on the part of any of the Suppliers. Nothing in this paragraph attempts to exclude or limit our liability for death or personal injury arising from any negligent act or omission on our part.
Nature of Benefits
In certain cases the availability of the services which are the subject of the Benefits may depend on external factors beyond our reasonable control. Accordingly, we reserve the right to eliminate, add, change and substitute Benefits and Suppliers without notice to you provided that the combined Benefits available are of substantially equivalent type and value.
Alterations to these terms and conditions
These terms and conditions, including the Benefit Terms, cannot be altered by either you or us without the agreement of the other. Please do not rely on promises or claims written or verbally made by anyone other than us or our authorised agents. If any of the terms of this Agreement shall become invalid or unenforceable, the remaining terms shall not be affected.
Relevant Law
The laws of England and Wales will apply to these terms and conditions.
Data Protection
Your personal details (as supplied to the Client or us when applying for the Benefits Pack) will be held by us and used by us for the purpose of the administration of your Benefits Pack, research and analysis and, where you have given your consent, for marketing purposes. Where we contact each other by telephone, calls to or from us may be monitored or recorded for training purposes. Where you have consented to receive marketing information from us and subsequently decide that you no longer wish to do so, you should notify us in writing and we will comply with such a request. We will only disclose your personal details to our employees, service providers and agents involved in the processing of the Benefits Pack services, or where relevant, involved in the marketing of Freetime Savings Club, and they will not be made available to any other company or organization unless you have given your consent. We shall require the recipients of your personal information to keep it confidential at all times and not to disclose to any unauthorised parties. If for any reason we need to transfer personal information outside the European Union for a specific purpose, we will ensure that it is treated to UK standards. We are committed to maintaining your personal information in a manner which meets the requirements of the Data Protection Act 1998 and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction. You have a right to ask for a copy of your information (for which we may charge a small fee) and to correct any inaccuracies in your data.
